1) GENERAL BACKGROUND

East Asia and the Pacific has the lowest ratification level of the international crime and drug control conventions. This is a fundamental problem. A recent ASEAN report notes that the regional mutual legal assistance (MLA) framework established by ASEAN is impeded by a lack of national legislation and capacity to apply the often complex legal tools.
The report specifically states that, �While some bilateral MLA agreements in the region show promise, the challenge is to find operational solutions for wider implementation.� Until the use of MLA and other legal tools becomes the status quo, a divided �patchwork approach� of agreements will prevent greater success.

The current approach to combating TOC consists of each country attempting individually, or in small groups, to combat distinct types of crime � human trafficking, drug trafficking, corruption, etc. The interrelated nature of the crimes and, more importantly, who is committing those crimes, is underemphasized. The divided approach currently in place to counter transnational organized crime is of limited effectiveness. What is required is the establishment of a transnational organized justice scheme to coherently combat transnational organized crime.

2) OBJECTIVES OF THE ASSIGNMENT


Performing a general analysis of the current legal procedures in place within a selected sample of South-East Asian and Pacific countries in order to understand the main obstacles and impediments to an effective international cooperation on criminal justice, at judicial and law enforcement level.

3) SCOPE OF WORK


It will be the responsibility of the Criminal Justice Junior Researcher to support the attainment of UNODC corporate goals in East Asia and the Pacific within the programme Towards AsiaJust � sub-programme 3 of the 2009-2012 Regional Programme Framework.


4) DURATION OF ASSIGNMENT, DUTY STATION AND EXPECTED PLACES OF TRAVEL


Duration: Twelve months. The assignment is expected to start in December 2010
Duty Station: Bangkok, Thailand.


5) FINAL PRODUCTS


Under the overall direction of the Regional Representative for East Asia and Pacific, and with the guidance of the Senior Prosecutorial and Judicial Advisor, the incumbent will carry out the following tasks:

1. Researching on crime trends, criminal justice systems and prosecutorial and judicial practices in Asia and the Pacific region in consultation with institutes of criminology, prosecutors and judiciary
2. Support the development of a comparative survey of CJ systems in the region (e.g., common/civil/Islamic laws) with a focus on transnational asset recovery.
3. Collect and analyze documents and statistics relevant to the objectives of Towards Asia Just- Module 1 : Judicial and prosecutorial capacity building on Asset recovery
4. Support the organization of a regional validation conference on the findings of the survey.
5. Assist implementation of Prosecutor�s Exchange Programme or PEP and provide documents to the participants in PEP with help of institutes of criminology in the region.
6. An academic article on asset recovery in collaboration with institutes of criminology and academic institutes in the region
7. Support drafting of �Practical Manual on Investigation and indictment of Asset Forfeiture�
8. Any other duties as assigned by the Representative of UNODC Regional Centre and Senior Prosecutorial and Judicial Advisor.


6) DEGREE OF EXPERTISE AND QUALIFICATIONS


� At least Bachelor�s degree in law and/or prosecutorial, political or social sciences, international relations or similar academic background.
� A minimum 1 year of professional experience in the field of research, reporting and analysis with international, government or private sector institutions, preferably within criminal research institute in the region
� Prior experience in working for research institute which has partnership with the United Nations system would be an advantage, but not a requirement.
� A minimum 1 year of professional working experience in East Asia and the Pacific Region
� Fluency in English.
